ACCEPTABLE USE POLICY

You must accept the terms of this Policy in order to use the Services.

NOTWITHSTANDING, BY USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS POLICY AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS CONTAINED HEREIN AS WELL AS ALL TERMS OF SERVICE INCORPORATED BY REFERENCE.

The Terms and Conditions set forth herein constitute the full and complete Acceptable Use Policy of Canhost INC., (doing business as and hereinafter referred to as ” Canhost “) Your agreement to be bound by this policy is acknowledged by your use of the Canhost Inc. pages Web Site, Hosting Services, Support Services and any Canhost Inc. software made available to you. The terms contained herein supersede and replace any other agreement or negotiation between you and Canhost Inc. whether oral, written or otherwise including any statements made by any representative of Canhost Inc. at any time.

Canhost Inc. does not routinely monitor the activity of accounts except for measurements of system utilization and the preparation of billing records. Canhost Inc. will respond appropriately to inappropriate use of services.

USE:

– Subscriber Responsibility

Subscribers are expected to use Canhost Inc. services responsibly, with practices that are considered acceptable by responsible Internet users and that do not harm, annoy or offend others. Canhost Inc. will make the final decisions as to what is considered acceptable use.

– Information Dissemination

The subscriber acknowledges that information acquired, obtained or disseminated through the internet is not monitored, verified, nor vouched for in regards to accuracy or quality by Canhost Inc.. The customer is required to exercise prudent judgment in regards to obtained information. Canhost Inc. is held harmless for injury by subscribers for communications on the internet that result from inaccurate, unsuitable, offensive, or illegal information.

– Third Party Accountability

Canhost Inc. customers will be held liable and accountable for any third party using their account that violates the guidelines listed in the Acceptable Use Policy.

VIOLATIONS:

– Illegal Use

Canhost Inc. services may not be used for illegal purposes, or in support of illegal activities. Canhost Inc. reserves the right to cooperate with legal authorities and/or injured parties in the investigation of any crime or civil wrongdoing. Cooperation includes the disclosure of any or all subscriber information including assigned IP numbers, account history account use, etc. to any law enforcement agent who has the proper warrants and subpoenas, without further consent from, or notification to the Subscriber. In addition Canhost Inc. shall have the right to terminate all service set forth in this policy.

– Fraudulent Activity

Any use of Canhost Inc. services to make fraudulent offers to buy or sell products, items or services or to advance any type of financial scam such as `ponzi`, `pyramid`, or `Nigerian` schemes, or `chain letters`. Any activity that involves a knowledgeable misrepresentation or misleading statement, writing or activity made with the intent the receiver shall act upon it.

– Spam/Usenet Spam

Use of Canhost Inc. services to transmit any unsolicited commercial or unsolicited bulk email is expressly prohibited. There is a no tolerance policy for the use of Canhost Inc. networks for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ or charter of any newsgroup or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted. Violations of this type will result in the immediate termination of the offending Canhost Inc. account.

– Threats

Use of Canhost Inc. services to transmit any material, whether through email, uploading, posting or other means, that threatens or encourages bodily harm or destruction of property against any individual, organization, or group.

– Unauthorized Access

Use of Canhost Inc. services to access, attempt to access accounts other than your own, or to penetrate, attempt to penetrate security measures of Canhost Inc. or any other entity’s computer software or hardware, communications system, whether or not the intrusion results in corruption or loss of data, is strictly prohibited and the offending Canhost Inc. account is subject to immediate termination.

– Distribution of Viruses

Intentional distributions of software that attempts to or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited and the offending Canhost Inc. account is subject to immediate termination.

– Collection Of Personal Data

Use of Canhost Inc. services to collect, or attempt to collect personal information about third parties without their knowledge or consent is prohibited and the offending Canhost Inc. account is subject to immediate termination.

– Forgery Or Impersonation

Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.

– Harassment

Use of Canhost Inc. services to transmit any material through email, posting uploading or otherwise, that harasses another. Complaints of harassment shall be investigated by the proper authorities in order to comply with legal obligations.

– Email/News Bombing/Message Forging

Malicious intent to impede another person’s use of electronic mail services or news will result in the immediate termination of the offending Canhost Inc. account. Forging any message header, in part or in whole, of any electronic transmission, originating with or passing through Canhost Inc. services is considered as a violation of the Acceptable Use Policy and the offending account is subject to immediate termination.

– Network Disruptions

Using Canhost Inc. services for any activity that affects the ability of people or systems, to use Canhost Inc. services or the internet. This includes DOS (Denial of Service) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited.

– Copyright Or Trademark Infringement

All material transmitted, posted or uploaded by subscribers shall conform to Canadian law in regards to copyright and trademark infringement.

– Harm To Minors

Use of Canhost Inc. services to harm or attempt to harm minors in any way, including but not limited to child pornography.

– REVISIONS

Canhost Inc. reserves the right to revise, amend, or modify this AUP (Acceptable Use Policy) at any time and in any manner. Notice of any revision, amendment or modification will be posted in accordance with Canhost Inc. Terms Of Service.
